Legal Question in Wills and Trusts in Massachusetts

Taking out a lien

Can I place on lien on my parents' house against my brother who is Exec? Parents both deceased and he is selling for 3 million. Unanswered questions...no contact...switched to a trust so I am getting nothing. Long sad story ...can I file a lien on my own? Thanks

Retain an attorney. There may be many things you can do to protect your interest in the estate, But there are many questions that need to be answered to decide what course you should follow. Good Luck!

Re: Taking out a lien

There is a great deal of information that is missing from your question, but there is nothing in your question to support a lien.

You may have a case for undue influence if the trust was created under certain circumstances but a great deal more information is needed to evaluate the circumstances for any challenges.

Was there a Will? Is there an estate open in Probate Court?

Please feel free to contact me if you want to discuss the matter without obligation.

Re: Taking out a lien

A lien must be based on a debt or a judgment.

You have described nothing that would support a lien. There is muct you have not told me. You mentioned a trust that you suggest he created.

Did your parents have a will?

Was he named its executor, and appointed by the probate court?

Did the terms of the will provide any property for you?

These and other questions and issues must be addressed before anyone can view the situation as a whole. You are welcome to contact me if you wish to provide me with more data, or ask me.
