Legal Question in Wills and Trusts in Massachusetts
temporary executor was apointed for 3 months. Executor knew of existance of 2011 Will, but filed a petiion to probate 2001 under which he is the administaror and gets 120K per year for adminitration. He ommited to present 2011 Will to judge.
would it be considered as fraud? what kind of fraud?

It is a breach of fiduciary duty and international misrepresentation assuming the decedent did not destroy the 2011 Will.
