A Will is supposed to be filed for Probate within 30 days of the deceased's death. However, if no one files the Will, a realitive can file a Petition for Administration of the Estate and seek to find the Will and have it admitted.

However, a Will or an Administrative Petition may not get control of assets held in Trust or disposed of by direct disposition such as being named a beneficiary under a life insurance policy. If you have a real concern, I suggest you contact an attorney immediately.
