Legal Question in Wills and Trusts in Massachusetts

If I am a trustee of my mothers trust who just passed and I requested that the beneficiaries will not sign for the disclosure of the receipts and monies paid out during her life. What will happen to the trust and the assets?

Please accept my condolences on your mother's passing.

It's hard to answer without having more information.

You mentioned that you are the trustee, but are you also the personal representative of her estate? Performing the duties of personal representative and/or trustee and dealing with family members all at a time of grieving can be overwhelming. The duties and paperwork alone can be confusing. You don't mention whether there are any assets in the trust, or what the trust dictates in terms of distributions. It's unclear what exactly you are seeking from the beneficiaries and why. I strongly recommend that you reach out to a probate attorney, who can review the facts on the ground and provide you with some real advice on how to properly carry out your duties.
