First of all, I'm sorry for your loss. Second of all, was she a resident of MA when she died or was she a UK resident but happened to pass in MA? Third of all, You can. The process can be pretty straightforward. I would highly recommend that you work with local counsel to ensure that all correct forms are filed, all notice requirements are met, and any claims are handled properly. In addition, if court appearances are necessary, it will be good to have engaged a Massachusetts attorney instead of having to fly in from the UK.

Please let me know if I can be of assistance. I would be happy to help you navigate through a difficult time and help ease the burden in any way I can. The consultations are always free, so feel free to give me a call at 617-859-8966 or email at [email protected].

Please accept my condolences.

You can serve as personal representative, but you will likely need a probate administration attorney here in Massachusetts to assist you. If our office can be of any assistance to you or your family, please do not hesitate to contact our office. Best wishes, Chris Vaughn-Martel (617) 357-4898, [email protected].

My condolences o your loss.

You can be the personal representative but you will need some local representation to assist with the probate administration depending on the nature of the estate being probated.

Was your wife's primary residence at the time of her death the UK or Massachusetts? Did your wife have any assets in MA or the USA that were held in her name only or as a tenant in common with someone else.

Jointly owned property or life insurance policies paid directly to you or anyone else are not part of the probated estate.

If your wife had a Will the original or a certified copy if the original was filed in a proceeding in the UK, will have to be filed in the probate court.

I would be happy to assist you if you require assistance. You can email me at [email protected]
