Legal Question in Wills and Trusts in Massachusetts

My wife's father has been diagnosed with a brain tumor and is undergoing radiation treatment now. We are trying to manage his finances and have gotten a power of attorney to do so. But his long time companion whom he never married has signatory rights to one of his checking accounts. She opens his mail but as far as we know she does not have the authorization to do so. She also tried recently to get her name in another one of his accounts and it appears she did it without his consent as a "conveniece signer" through the telephone with a acqaintance that works at the bank. We are concerned that this lady may try to get my Father in Law's signature for other things and he seems at this point that he may not be in a good and stable enough state of mind to understand what he is doing. What are our recources at this point?

Joseph Murray Joseph M. Murray, Esq.

I am sorry your father in law is ill.

One option is to retain an attorney to petition the Probate Court to appoint you or some other suitable person as either Guardian of his person and finances or just Conservator of his finances. Good Luck!
