Legal Question in Wills and Trusts in Massachusetts

A will was found for my brother dated 6/11/87 which was never probated. He passed February of 2003. He was married in August of 1990. Does this marriage void that will and everything goes to his spouse? In the will he did state that he intentionally did not provide for any other persons. I am his sister and he appointed me executrix of his will and the beneficiary of his estate.

The answer to your questions is YES. Your brother's subsequent marriage invalidated his previous will. In that event, he died "intestate", and his estate would be distributed according to the laws of intestate succession at the time of his death.
