If my husband and I write up our own will and have it notorized, will it hold up upon our passing?

Re: will

You and your husband will need to set up 2 separate wills - one for you and one for him. You then have to sign the will in front of 2 witnesses. The 2 witnesses cannot consist of your husband or anyone else that is a beneficiary under the will. After the witnesses sign, you then have to have a notary notarize all 3 signatures.

Even though you can follow the procedure I laid out above to complete a will, you really want to have an experieced estate planning attorney to look over the will. In addition, a will is only 1 part of a basic estate plan. You should both have durable powers of attorneys and health care proxies.
