Legal Question in Wills and Trusts in Massachusetts

no will

my moms dad past away first then

my moms mother but the will was

only in effect if she died first So my

mother became the gaurdien of my

grandmother and her estate. but

when she passed away the lawyer

said that she would have to go

through everything again because

my grandmother had no will. the

lawyer put a bond on the money and

said my mom can''t touch it I do

have an aunt but she is on ssi, the

lawyer states that she is entitled too

half of the monies? Is this true and if

so what can I do

You could contact the attorney handling the estates and seek an explanation or retain your own attorney to advise you.

Your aunt is entitled to 1/2 the money. However, if your grandfather had a Will your grandmother might have anyway. If your grandfather died without a Will, then $200,000 plus half of his estate should have passed to your grandmother and the other 1/2 should have been split between your mother and aunt. That of course assumes there was anything that was not jointly held by your grand parents. If your grandmother died without a will then your mother and aunt split the amount of the estate equally from your grandmother. Your mother's half goes to you and any brothers or sisters you may have.

The inheritance will impact your aunt's SSI. However, your aunt is not entitled to any part of your mother's estate.
