Legal Question in Wills and Trusts in Massachusetts

Are all wills documented somewhere?cousin claims aunt died without a will.
My brothers and sisters feel that our aunt had a will upon death maybe in Northfield VT or Worchestire County MA. At time of her death the address was Grace E. Fiske, 13 Dewey Ave. Morningdale MA She lived with her sister(now deceasded) and our cousin. Our family believes that the will or wills left the majority of VT property to our family Our cousin insists that because of no will he is intitled to half. Why then wounldn't we be intitled to half of the MA property? Aunt Grace died in MA about 1978. Thank you for your help!

The answer to you question depends in large part upon

the deeds to the properties. Were the properties in your aunts name alone or

is the property owned jointly with another, is the joint tenancy with or without

rights to survivorship. Is you cousin the decedent's child. If so

your cousin may take all of the property over you, were your aunts siblings alive when she

died? If so, they may take any property over your rights.

In short, I need more information to answer your questions. You should consult a lawyer.
