How long do you have to file a will?

Under Massachusetts law, the will is supposed to be filed thirty days after the death. The law has no teeth unless someone who doesn't have the will and wants to see it goes to court to request an order to produce the will.

The statute provides for filing a Will 30 days after someone dies. There is no real penalty for failiing to do this within 30 days. However, the general rule is to file a Will as soon as practical after the 30 days has lapsed if you have not done so before.
