Legal Question in Wills and Trusts in Massachusetts

wills etc

my mother passed away in January and my sister was named executorin March she sent a letter to all of us to clear out anything that we might still have at the house so she could get it on the market as soon as possible.now I have two brothers that have been living at the house for 10 years to ''take care of mom'' and now seem to be in no rush to leave or even help get the house ready for sale. my sister who lives in another state seems to have frustrated one lawyer and still no sale on the house ....so my question is what are my rights to get my family to sell this house so we can all have a nice amount to help us all move on to the next faze of our lives? one more thing my family does not like me and couldn't care less what I want or think is right

Re: wills etc

The executor has a duty to the entire family to move the process along. She should be gently-but-firmly moving forward on the sale. (Of course, given the real estate market, I wouldn't expect a fast sale or a sale for a price which you would prefer to see -- but that's another issue.)

If you have a poor relationship with your relatives, it may be better to allow an experienced probate attorney to review the situation and intervene on your behalf. Some polite-but-firm inquiries from an attorney might be enough to get things moving forward. In a worst-case scenario, the attorney could head into court to seek relief or even replacement of the executor. However, these procedures can get expensive -- and you will be expected to pay for representation out of your own pocket.
