Legal Question in Wills and Trusts in Massachusetts
Wills
My mother, 85 years old, living in Cape Cod Massachusetts, has just married a man who is 61 years old and has been living with her for four years. It is my understanding and my sister's understanding that this man is a gold digger. We visited with her in Oct/Nov/Dec of 2008 because we found out she was hospitalized and were not informed. This person has prevented my sister and I from visiting with my mother for 4 years. Her whole personality changed when she became involved and now she has married him and appointed him executor. She is in IV stage pancreatic cancer and chemo is not working. She has very little time left according to the doctors. What recourse do we have? He has made statements to my sister and myself regarding ''I am not finished with you two yet!'' He is very smug and obviously well practiced in this type of elderly abuse. He has stolen from my mother, I have had reports of him hitting her, which she denys, frankly she doesn't remember a lot of things but is not considered incompetant??? Within a few short months he was able to get my mother to close the door all all of her friends and family. What can we do? We were always close and now she is someone I do not even know.

Try for a guardianship, if you have reason to questions her competence.
