Re: Employer wants to help get Work Visa
The employer and employee should consider a confidential consulation with an immigration attorney. The employee has several roadblocks, including the illegal entry, which bars most immigration benefits. It would require a re-entry to the US in a lawful status; but he would first face a 10-year re-entry bar for the illegal stay; for which a waiver may or may not be available.
Secondly, the four years of illegal employment impose additional roadblocks, particularly in establishing his qualifications for the job.
These issues need to be discussed with your attorney in confidence, to explore, what if any, options are available.
