Legal Question in Immigration Law in Mexico

L2 visa application

In May 2007 got legally divorced

from my husband in Mexico City(he is

Mexican I am a legal alien in Mexico

with a resident permit,Hungarian

citizen).Less than one month after

divorcing we got back together and

since then live together as

before,shared bank

accounts,everything just didn't got

remarried on papers. His company is

sending him to US as a manager for

a US company with an L1 visa. Based

on our marriage certificate which we

still have in its original, I could follow

him on an L2 visa. Is there any

chance that when applying at the

Embassy of US they do extra

research to find out if we're still

married? We don't want to get into

legal problems and rather would not

apply if knowing that such will cause

legal problems. I already had an L2

visa as a spouse,extension of his L1

visa and lived in the US for 3 years

from 2005-2007.The issue now is

that at one moment of crisis of our

relationship we went thru a non fault

divorce and after less then a month

we realized the mistake we made and

got back together and strenghtened

our previously weakened relationship

taking it to a whole different level.

We want to live together while he's

abroad too .

In this moment, your 'L2' is not valid now. You are not married. 'L2' is only for wife or children. If you have not a valid marriage certificate, is not valid your 'L2'. You must request for a different visa.

If you show your old marriage certificate, USICS may "think" about a fraud from you.

I suggest you request for a new visa or get marriage again quickly.
