Legal Question in Personal Injury in Mexico

sexually assulted on a cruise

I recently went on a cruise and was sexually assulted by a cruise guest. I did not press charges, but was reassured the guest was being watched, International law? what law is applicable, it was in International waters? I am a business invitee, which makes the cruise line owes me the highest duty of care. The trip was my honey moon, and it was ruined, I will not go into detail, but my question is, I called and the cruise ship said they are not responsible for what other guests do? I emailed them for some type of compensation, they said flowers in room on next cruise! I was shocked, I assumed they would compensate me with a free cruise or atleast a discount. In addition we bought a ring for 875.00 on the ship and they assured us of the value, its worth 400.00. Can you give me some direction, so I may research? Is it tort, civil, ??? Thank you for your time.

Re: sexually assulted on a cruise

I've heard that cruise lines usually subject their clientele to a specific jurisdiction based upon their contracts. Jurisdiction is already determined on your purchase ticket in case you should sue for any reason. In Mexican law, a boat or a vessel that is from our country, subjects its passengers to Mexican law, because it is considered to be Mexican grounds, regardless of where the boat could be. I assume that such principal applies to US law and therefore, if it was a US ship, you should be subject to US law. Which State law will then be followed?, it depends on which state had closer grounds or contact with your matter.
