Legal Question in Real Estate Law in Mexico

U.S. Citizen & Mex. National living in Mex.

I am a U.S. Citizen & my husband is a Mex. National. We will be moving to Puerto Vallarta. My question is can I, as a foreigener, be on the deed if it is ocean front property? What happens if we divorce? Will I have any right to the value of the property?

You need to request the formation of a trust so you can be named beneficiary, together with your husband and you will require a visa status in order to execute legal documents in Mexico (the trust). If you were not married in Mexico it will be assumed you are in common property, so half of all assets and liabilities in Mexico will be yours.

Indeed, you are entitled to appear on the Deed only if a Trust is implemented, and the Marriage Certificate is duly revised in order to make sure that not specific clauses constrain your rights.

Yes you can buy a Property near the ocean front, but you will need a trust because as a foreigner you have some restrictions but with the trust this restiction is over.
