selling house willed to meq

my brother in law was willed a house by his grandma with his mother as executor when he was a child. he is now in his 40's and the house is for sale in mexico but the will never went through probate and he cant wait for all that and sold his ownership to his brother (my husband) for $5000 so he can move on. what kind of contract do we use so when the house goes through probate my husband can take title and sell if he decides to without my brother in law saying he never sold his interest to my husband.
