Child Support
I currently reside in Michigan and my former boyfriend with whom I had a child with wants to cut my child support. He is not currently working, but I know he has a large sum of money in the bank. Will the court use the money that is in the bank as a basis for the support or only the interest from this money?

If he has money in the bank, the court is not going to look kindly on a request to lower support.

Generally, only the interest is used to determine income when utilizing the Michigan Child Support Guidelines. However, it is important to know why the father of your child is not working, the court can imput him with income under certain circumstances.(that means when computing the guidlines he will be seen as having an income even though he is not working), if you wish to discuss this further please feel free to call me at 248-258-0800 Sincerely, Mark Snover

Both the principle and interest are factors to be considered by the court. What you need to do is to get a court order requiring the bank to release the records to the court. Bill Stern 248-353-9400
