Re: probation violation
A probation violation subjects you to being resentenced on your original charge. Therefore, it is not a new crime. However, it could result in new jail time depending on the severity of the violation. You are entitled to a hearing but the standard is a preponderance of the evidence and not beyond a reasonable doubt. I would encourage you to consult with an attorney regarding your possible consequences.
