Legal Question in DUI Law in Michigan

Suspended License for DUI 2nd Offence

My husband lost his license after his 2nd offense for DUI. He did all his fines, community service, etc. and reapplied in front of a board after 1 year and was denied. He was frustrated and decided not to reapply the next year. He has now been without a license for 5 years and is ready to do whatever necessary to get it back. Does he have to go in front of an appeal board again? Do we need legal representation? Where should we start? Will he automatically have to have something installed in our vehicle, etc.

Before I get too involved in your answer, just tell me if your husband has stopped drinking.

If he hasn't, you don't have to reply.

Re: Suspended License for DUI 2nd Offence

Being denied the appeal the first time is typical. Even before you walk in to the hearing, the appeal officer has pretty much decided against you unless you can present clear and convincing evidence that you will not drink and drive again. There are a lot things you can do to help you win the next hearing and unless you do those things you will denied again and you will have to wait another year. If you want to call my office we can talk about this.
