Unlawfull Termination

Can a company terminate your employment while you are still on Long Term disability through that same company? I have been told that Best Buy is terminating my employment with them even though I am still on Long Term Disability.

Under federal law there is nothing to prohibit an employer from terminating an employee on LTD. The very essence of LTD is that you cannot work and do not know when you can work. Generally, under federal law, once you have exceeded 12 weeks of this leave time, your job is no longer protected.

State law may provide a different answer and you should contact an attorney in your state to discuss those issues.
