It means that in cases where you do not have an automatic right to appeal to a higher court, you must ask permission to be allowed to appeal. You are requestintg "leave to appeal". Bill Stern

"Leave to appeal" refers to a grant of permission by the appellate court for the appeal to proceed.
If you have an "appeal by right", you don't have to ask the appellate court's permission to proceed with an appeal.
Where appeal is by leave, you must obtain permission ("leave to appeal") before you can proceed with the appeal.
