Legal Question in Appeals and Writs in Michigan

garnishment

I have had a landlord garnishing my wages, and recently my employer sent a final statement of periodic garnishment because it had expired, but the total has not been met. Today I received a new writ, is that legal to re-issue a new writ once one has expired?

Re: garnishment

Yes, it is legal to reissue a garnishment after the first one expires. The judgment is good for 10 years and on that one judgment, there is an unlimited number of garnishments that can issue. The creditor can reissue the judgment prior to the expiration of 10 years to make the judgment good for 20 years. William S. Stern
