Legal Question in Appeals and Writs in Michigan

rights on dropping charges

I just have a question on if the victim of a crime can drop charges files on someone. The person has been arraigned and is being charged on criminal sexual conduct- assault with intentto commit sexual penetration. But the victim has decided to drop charges and wants to know if it can be done.

Re: rights on dropping charges

The alleged victim needs to speak with the prosecutor regarding changing her story. Generally, if there is no complaining witness, the case will not go further. However, some prosecutors may feel the need to continue with the case if they feel the complaining witness is lying to protect the defendant or has been threatened to drop the charges. I am assuming this is a "she," and she may want to seek legal counsel if that occurs.
