Legal Question in Banking Law in Michigan
My brother passed away prior to changing his beneficiary from his IRA account over to both of his sisters. We are obviously unable to retrieve any information if he had a previous beneficiary or not. If he did not have a beneficiary listed, what is our next step to make the proper changes? He did not have a will or an executive attorney. He passed away suddenly. Thank you

I hope you know who the IRA account is with. When he opened the account, the custodian of the account would have required him to fill up the name of spouse as beneficiary as default. If he was not married, only then he could have filled someone else's name. Go the custodian with the death certificate and ask to check his IRA account. They can atleast say whether or not you are on account without divulging who the actual beneficiary might be. He has to have a beneficiary listed on IRA account.
