Legal Question in Bankruptcy in Michigan
My attorney never provide information to me that I needed to complete a debtor's education program after my chapter 13 was completed. Can I re-open my case to file this form now?
1 Answer from Attorneys
San Diego Bankruptcy Attorney It's generally not the attorneys responsibility to manage your obligation to complete the dec course. The information is widely available and everyone who files knows how to access it on the internet.
Additionally the court sends you a notice to complete the course before closing your case without a discharge, and you also sign to knowledge that you must complete this course when you file your bankruptcy papers.
Usually you do it through the same provider that did the initial credit counseling course.
Since you are saying you didn't do it because you where waiting on information from your attorney, then you where unreasonably confused about your olbigations and it was not your attorneys fault.
You can still re-open the case and file the certificate, but it appears as though it was not your attorneys fault so you will have to pay a new attorney and a filing fee.
