Legal Question in Bankruptcy in Michigan

A collection company is threating garnishment on an old credit card from 2003 in the amount of $1,300. My question is; If I file bankruptcy on this bill, will effect my wife's credit? We were married in 2005 and this bill was mine before we were married. Thank you.

When you file bankruptcy you do not get to file bankruptcy on only one bill (and it would not be worth it to file for a mere $1,300 because a bankruptcy attorney can easily cost that much to hire). If you have other bills that you have jointly with your wife, it COULD have a negative impact on her credit if you and her cease paying those debts. With that said. If for whatever reason a bankruptcy was reported on her credit report, she should be able to contest that successfully and get it corrected. If this is the only debt that you are concerned about,you should look into negotiating the debt. You don't say whether they already have a judgment against you or when the judgment was entered. If there is already a judgment it will be difficult to negotiate the debt.
