Legal Question in Bankruptcy in Michigan
Bankruptcy debt-who is responsible
I'm legally married, but have been separated from my husband for at least 12 years, and we have lived apart all of those years. If i file for bankruptcy, is he responsible? My name is on the condo her lives in. Will this entrer into the situation? Would he even have to know about this bankruptcy. His name is not on any of the credit cards that are the reason for the bankruptcy. Thank you.

Any co-debts you have together, anything you both co-signed, will be your joint responsibility until or unless one of you files for bankruptcy. At that point the responsibility to pay the debt falls to the other person. So long as he pays for the condo, he will not lose it, but since you seem to have the rest of your debts in your own name, and there is little possibility he ever enjoyed the fruits of your debt, it should not affect him.
