Legal Question in Bankruptcy in Michigan

bankruptcy and divorce

We were told before by a debt consolidator that our only alternative was to file bankruptcy due to our debt amount compared to our income. Since then things have happened in my relationship with my husband, criminal acts on his part and I want to divorce him. I need to know if I can still file bankruptcy? Do I have to do it before the divorce is filed? After? When or if I can file for bankruptcy chapter 7, will the government take my tax returns? Will I still be responsible for my husbands medical expenses when they go to collection because of us being married? I have many questions and need answers as soon as possible, before my wages are garnished.

Re: bankruptcy and divorce

You can file before or after the divorce. Your debts will still be discharged, and those that are joint will fall to him to pay. If you file a Chapter 7 and your income is not high, nobody will touch your tax refunds. If you need more info, feel free to contact me! 248.569.1900. God bless and happy new year!
