Legal Question in Bankruptcy in Michigan
Bankruptcy
I have a question similar to last, we discharged our bankruptcy in March of 2009. Our timeshare which is owned free & clear is part of the discharge. However, the timeshare co. is billing us and threatening to take us to small claims for maintenance fees, besides accelerating the fees for rest of 09 (we pay monthly), and 30% penalty over balance due, a bill for $2800!!! Do you have any advice. We have looked through our contract and it doesn't address what happens if maintenance fee is past due.
thx

Re: Bankruptcy
You don't stop having an obligation to pay accruing maintenance fees after bankruptcy, you need to pay them, I'd recommend contacting them and working out a payment plan.
