Legal Question in Bankruptcy in Michigan
bankruptcy
If I sell a product to a company and they declare bankruptcy before I have collected and the company had prior knowledge that they could or would declare bankruptcy when they issued the purchase order, can I sue to recover the money that is owed?

Re: bankruptcy
It depends on the timing of when the product was sold, but I would be inclined to say yes, you might be able to sue. You might have an easier time getting the product back than getting the money, unless the product is the type that would have already been used. More details are needed to give you a better answer, but you should really consult a bankruptcy attorney experienced with bringing adversary proceedings against debtors (ie the company).
