Legal Question in Bankruptcy in Michigan

Chapter 13/foreclosure?

I own a home with an individual I am not married to. For the past 16 years I have owned and lived in the home. Last year he filed Chapter 13. The house was not included in the bankruptcy proceedings. However 6 months later he stopped making payments on the home and left. I have been trying to sell the home. When an offer came in I assumed the house was probably going into foreclosure. Upon contacting the morg. company. They said he put the home on the bankruptcy. what does this mean for me and my home?. Does this stop foreclosure? Can I sell.? Can I stay? what about taxes and insurance that were included in the morg. Payment are they still being paid? Can the morg. company foreclose? help!

Re: Chapter 13/foreclosure?

Your question is a little difficult to answer. If you give me the file number, I can look at the court docket through PACER.

If the home was not in the bankrupty and he stopped making the payments, the bankruptcy would no effect on foreclosure. If the home were in bankruptcy and he stopped making the payments, the chapter 13 trustee, Thomas McDonald, would file a motion to dismiss the case. You can call me for a free consultation at 989-791-1611.
