Legal Question in Bankruptcy in Michigan
foreclosure / bankruptcy
Hello,
I was engaged to a man in Michigan and we purchased a home together in 2006. We never married, and lived in the home together for approximately two years, before he broke off the engagement. I moved out of the home, and relocated to Chicago, IL, without getting my name off the mortgage. He has been claiming that he has been unable to refinance the mortgage to get me off, for the past two years. Now he is telling me that he has to file bankruptcy because he is unable to make the mortgage payments and that the home is being foreclosed. I never signed a quit claim, nor have i paid a cent on the mortgage since I moved out. So on paper, I'm still a homeowner, with a mortgage, that lives in a different state.
What options do I have? I can't make the mortgage payments - I have enough bills of my own, and I'd like to wash my hands of this whole business if possible at all - he claims the house won't sell anytime soon. Any advice on the matter would be much appreciated. Thank you so much!

Re: foreclosure / bankruptcy
If you are on the mortgage, quit claiming the house to him won't do any good. What you may be able to do though is arrange a deed in lieu of foreclosure with the mortgage company and sign it over in exchange for not owing a deficiency. it won't be good on your credit, but it will help you avoid bankruptcy.
