friend needs help on a foreclosure

What can an 86yr. old woman do about being herassed by a morgage company and a loan co. Her grandson bought a house but had her put it in her name saying so his ex-wife couldn't get it from him. It was for over $400,000 and then he didn't make the payments while him & his girlfriend were living in it plus him and his sister talked her into signing for a $50,000 line of credit for his pizza business. Then he claimed bankruptcy and left her holding the bag. Plus him and his girlfriend trashed the house and never paid the utilities so she can't even get the money out of the house if she sold it which she has tried. Her granddaughter talked her into putting the house she lives in in the grandaughter's name so the collection people can't take the house. But poor ladies bank account is depleted because of her grand children and has no one to help her. She's at the end of her rope and needs help bad. Please give some kind of advice. Everywhere she turns she seems to get screwed and she's a beautiful lady who was naive and just wanted to help family.

Re: friend needs help on a foreclosure

You raise some serious issues which cannot possibly be addressed on the internet. This lady needs to have a face-to-face consultation with an attorney. Her options include giving the house back to the lender, bankruptcy, or doing nothing. Her current assets will dictate in large degree what action she should take. Whoever told her to put her house in her granddaughter's name probably did not do her any favors. If this transfer of the house was to put her assets out of reach of creditors, the transfer could be voided by a court as a fraudulent conveyance.

Beware of taking legal advice from a non-attorney or giving legal advice if you are not an attorney.
