Legal Question in Bankruptcy in Michigan

Mortgage no equity; time before eviction

I have filed Chapter 7 Bankruptcy and am unable to get a clear answer to the following question from my attorney, and would appreciate any help you can give me.

I have a modular home which is financed through a finance company; there is no equity in the home as I have had it only a year. If I stop making payments on this home, what could I expect as the least amount of time I would have before I would be evicted? Would they go through an eviction process or foreclosure process, and what would my time frame be until I was forced to leave?

I have had my initial court hearing but am still awaiting the final hearing before a judge, and I must make a decision soon as to whether or not I want to let this house go back to the finance company. To make that decision, I really need an answer to the above question so that I weigh all my options and make the right decision for my family.

It sounds like your lawyer is giving you the right advice, and the fact that he is giving you an answer you do not want to hear proves that he or she is a lawyer you can trust.

The fact is, no lawyer can tell you what the bank is going to do, or how long it will take.

Sorry. I know you would like something more certain, but that's what life is all about - none of us knows what will happen in the future.
