Legal Question in Bankruptcy in Michigan

School loans

Have received a notice that my S.S.D. payments are to be reduced to satisfy a 7 year debt for a school loan. I have numerous other debts that occurred before my disability. Can I put my school loan on a bankruptcy petition, along with my other debts, I cannot absorb this reduction.

While most debts are dischargeable in bankruptcy, educational loans guaranteed by the U. S. government are generally not discharged by a Chapter 7 or Chapter 13 bankruptcy. However, they may be dischargeable if the court finds that paying off the loan will impose an undue hardship on the debtor and his or her dependents. With a disability, you may be able to discharge your student loans as well.
