Legal Question in Bankruptcy in Michigan

settlem of Divorce judgment

My ex filed for bankrupcty 52 days after judgment was final. He recieved the marital home in return I was to recieve $56,000.00. I walked away with my clothes and $750.00 month in child support. My setlement was worded as equity in the marital home. What are my chances of recieving my settlement. Please what can I do if anything....

Divorce or child support settlements or monies owed are NOT dischargeable in a bankruptcy case - despite how they are worded in the judgment. If he has listed you on the petition or otherwise attempts to have his debt owed to you discharged, you must object and dispute the discharge so that it survives the bankruptcy.
