Legal Question in Business Law in Michigan
I broughy my broken ipod (headphone jack), to a repair shop located inside the mall. The owner fixed the problem, then proceeded without my knowledge to replace my hard drive and erased over 6800 songs. Can I file any legal action against this company?
1 Answer from Attorneys
Any attorney will say if they replaced your hard drive without consent (and apparently totally unrelated to the problem you brought it in for repair) the shop is liable for damages. Proving your damages is the real issue. Will you be able to prove it had over 6800 songs that were erased? Depending on the dollar amount involved, it may be a matter for smalls claim court. Consult with a good business attorney in your area for specific advice.
