The attorney we hired for a biz lawsuit we are involved in has let the discovery time lapse and took NO depositions in that time frame even though a witness list had been previously provided to him. He is now saying that unless we can get our out of state witnesses to agree to testify at the trial then we are out of luck (he asked for additional discovery time from the court but it was denied). This case could not only cause us to lose a significant amount of money but also could cost us our good name with our customers. (My husband is a sole proprietor) We have a good case but need these depositions and the added discovery time. Please understand that this is our first time in a lawsuit so we are at the mercy of our attorney to let us know what he needs from us (which we always provided in a timely manner). He has made it out to be our fault that the discovery time lapsed without doing any depositions, however, we didn't know that we were supposed to schedule times with the witnesses, etc. The attorney is retained on a contingency fee with added money for court costs etc. If we appeal the deny for added discovery time, we will need to pay additional $5,000 to $10,000 to proceed (not included in the cont. fee) Advice? Help

You have not provided enough facts for a complete answer. Hiring an attorney is just like selecting a doctor. Trust your instincts. If you are not feeling better with a doctor you get a second opinion. In this case you may want to consult another local attorney. There is no excuse for missing deadlines.
