Business Partner Doing Drugs
I currently have a S-Corporation in Michigan. My business is a hookah lounge (non alcoholic tobacco lounge) I have one partner (my ex boyfriend) in which the business shares are 50/50. I have had many problems with him. Such as:
Physical Abuse
Verbal Abuse (in front of customers)
Stealing
Had drugs in the business
Him and his friends now always leave - smoke marijuana and come back in. I know he does this because he has Marijuana smell all over him. His eyes are also red and other obvious signs. They come back in and waste inventory by eating snacks, and smoking tobacco.
I really don't want a partner in there that is using an illegal substance. I want a drug free workplace! He damages the business, yet there's no way for me to void him from the corporation since it is equally 50/50. I do hope there is a law or way to get him out of the business because he is breaking the law. Is there any way I can force him to a unexpected drug test? Or enforce a drug free workplace without his approval?
FYI: I can't leave the business as I have a loan still owed in my name. I offered him a buy out amount, he did not approve. He also won't buy me out. We have been trying to sell for months.

hopefully your partnership agreement provides for a buy-sell agreement, which should assist you in the breakup of the partnership. If not, you are stuck suing him in court to get the judge to decide the issues. Visit www.kliszlaw.com to discuss. Tim Klisz
