Legal Question in Business Law in Michigan
Contract?
Hello,
In short. Can I be sued to pay for a service a neighbor has taken upon himself to pay for.
Basically, 7 neighbors are on a private sewer line. Two of the 7 were having trouble with thier sewer lines. Back-ups and such. One neighbor decided (because he is a land-lord) to hire a private sewer cleaning contractor to snake the line, power jet the lines and then replace a 12 foot section of the line for apporximatley $5,500.00 dollars. He is now threatening legal action (small claims court) for payment from the other 6 neighbors. I have refused to pay because he had not consulted with me or any other neighbors regarding the services. Does he have a case? There was no contract. No offer. No Acceptance.

Unless there was some type of Agreement already in place that gave your neighbor the authority to obtain the repairs, he should not be able to successfully sue you to pay for them.
