Modeling Agreement Failure To Pay

I own a small modeling promotion company. That promotes local models. My model recives a discount on thier photos. They only pay $75 per shot. This girl did her photo shot and I give her the photos so she could decided which ones she wanted to release. Now, she does not want to sign the release of photograph forms. So, she must pay the difference for the photo shot which is $225 dallors. $200 photograher fee and a $100 styling fee. She took over 300 photos. Now, she is dodging me. what should I do. Smal claims court. I have her model application, receipts of payment for $75, and witnesses that can say why she was taken photos.

Your best bet is small claims court. It's the least expensive option for you to pursue. If she signed an agreement that talks about the photographs you're in excellent shape. If not, then you can still pursue her under a theory called "quantum meruit." Basically, this means that you did something that benefitted her and it would be unfair for her to keep it for free. I would just file the papers and tell the court what you told her b/4 the pictures were taken and how she failed to live up to her end of the bargain afterward.
