Legal Question in Business Law in Michigan

non compete clause

at the end of my first day with my employer he had me sign a agreement stating that for a period of 48 months and within a 50 mile radius that I will not own, manage, operate, join, control,or be employed with any business of this type. It was only signed by us not in front of a notary or attorney or any other witness and was not presented in the previous two weeks, but after my first day when I already left my other job. is it still binding?

Re: non compete clause

It is binding despite witnesses, etc. The real question is it enforcable. The 48 months seems very excessive and might get reduced by a Judge for principal fairness. Contact me at www.kliszlaw.com to discuss the details. Tim klisz
