Legal Question in Business Law in Michigan
I am a service-connected disabled veteran about 31 years old. I was hired on as a National Sales Manager by a company. I was fired after only 87 days and the reason was "I wasn't taking their company in the right direction" even though I increased traffic to the e-commerce giant by over 400% in the first 7 days. Since the firing May 2, 2010 I launched my own company and I am a competitor. I am using different materials, different process and I started completely from scratch. The business has no patents of any kinds since this market has been around for over 20 years and they're are hundreds of people doing digital printing. They're suing me because I did this, but I never signed a non-compete clause just a confidentiality agreement. I want to file a counter suit for commissions they never paid me on from the business I established. Turns out they have brought on several people before me and did the same thing to them, hire em, get them to work for nothing and then fire them before any commissions have to be paid and before benefits kick in...they fire people just before 90 days...they hired a guy after my firing and just fired him I found out on the 89th day! Please help!!!

Any attorney will say the easiest way to get unpaid commissions is to file a claim with your state's labor or employment development department. The confidentiality agreement you signed needs an attorney review. These usually cover confidential information owned by your employer. Consult with a good business attorney in your area for specific advice.
