Legal Question in Business Law in Michigan

I would like to start a telephone company. that offers the same thing as the company Vonage..

they (vonage) rent people a device, that allows the customer, to plug their existing telephone into,,,, and cable ISP (that the customer must already have etc)....

then they can make local and long distance calls from that phone,,,,,

and pay Vonage a monthly charge for the service etc..

...........................................................................................................

MY QUESTION....

can I start a company,,, and legally RENT a customer a computer for say 20 bucks per month..... for the computer rental alone...etc..

the computer I rent to them will already HAVE a (Magic Jack IP telephone device) ( one that I purchase from Magic Jack.com and OWN)

hooked up to the computer and installed, and be already working,,,,etc..

the computer will be fully capable of making free local and long distance calls etc..... just like the Vonage device is......

>> the computer I rent to my customers ...will come with FREE local and long distance Magic Jack service already installed etc...

I own and Pay magic Jack,,,for the telephone devices, tel #'s, and the service etc... and ALLOW the computer rental customer to USE MY tel number and service, as long as they rent the computer from me...........

I only charge them for computer rental......the long distance Magic Jack telephone device and service are a freebie, while they rent the machine....

can I legally do this...without getting sued by Magic Jack ?

As a Franchise Attorney I can say this. The answer is Magic Jack very likely has language in it's contract or policies in place to prevent what you intend to do. Free riding on someone else's intellectual property is usually a good way to get sued. Consult with a good business or franchise attorney in your area for specific advice.
