Hypothetical

Ted hires a limousine to take him to an important business meetin wher he is to sign a million dollar contract. The limousine fails to appear, TED cannot get to the meeting and he loses the deal. Ted sues the limousines company for his lost profit of $300,000. what law is applied to win? UCC?

Ted probably loses. Sorry. Contract damages must be foreseeable and certain. In your case, the limo company will probably argue sucessfully that they had no idea what the consequences of failing to show were, and therefore they are not responsible. In a famous case, a factory was closed down because a part was not available on time. The part supplier was not liable for the closing of the factory. Good luck!!
