Background Checks
Our company has recently issued paperwork to all employees currently working and new hires wanting permission for background checks to be done at will. They are asking for permission to check criminal, s.s., vehicle, sex offender, etc. They also want a signature giving permission and relenquishing resposibilty of''I herby fully release and discharge (our company name here)or any authorized representatinve from all claims and damages arising out of or relating to any investigation of my background for said purposes.'' Is this legal and can they use this against employees already employed by the company who refuse to sign? Should we be leary to sign this release? I am assuming that youa re an "at-will" employee. that means they can fire you whenever they want,a s long as they do not violate some public policy or civil rights law. therefore, they can change the rules of the game whenever they want. If you refuse to sign, fine. But they don't necvessarily have to keep you employed either. William S. Stern
