False Arrest

I was arrested on a five year old bench warrant for contempt of court. After being booked and jailed I went before the judge the next morning and he asked me why I failed to pay my fine from a prior offense. When I told him that I had paid my fine and could produce reciepts to prove it he looked through my file and told me that would'nt be nessecary because my paid reciept was in my file. Then he asked why I was even arrested to which I replied ''My point exactly''. The case was dissmissed and instead of releasing me from custody they put me Back in jail until I could be processed. Can I sue?

If you paid the fine after the warrant was issued and did not appear before a magistrate to get it dismissed, you usually have no case.

If you paid the fine before the warrant was issued, you may have a case. Call me to discuss @ 248-680-1133.
