Hit By Drunk Driver - No injury. Is there civil recourse?

My car was totalled 90 miles from residence by a drunk driver. Insurance offered $1600 for the car - leaving me about $100 after lien payoff. I will need to replace auto, had to find transportation home, (and now to get police report and recover my license plate). Am an independent contractor and as such may be without work for at least a week while straightening out this mess, and buying a new car. Am looking to determine monetary recourse from the driver directly in at least the following amts: $5000 auto $2500 lost wages (one week) $100 mileage to and from accident site. Will this be possible or should I accept the insurance company's settlement?

The maximum recovery against the other driver is $500. The idiots in the legislature did not make any additional liability for being drunk. William S. Stern

You should strongly consider taking the settlement. Were the driver uninsured, you would be limited to $500...negotiate for w bit and see if you can up the number, but basically that's not a bad deal considering there were no physical injuries.
